MEMORANDUM OPINION AND JUDGMENT

COLLINSON, District Judge.

This is a seizure and condemnation action brought under the Federal Food, Drug, and Cosmetic Act (the Act), 21 U.S.C. §§ 301-892 (1970), to condemn a quantity of drugs known as “Myconox Medicated” (Myconox) and “Medi-Matic Free Choice Poultry Formula” (Medi-Matic). Plaintiff alleges that each article is a drug which is adulterated and misbranded while being held for sale after shipment in interstate commerce; and that, therefore, each drug is subject to seizure and condemnation within the ambit of section 334(a)(1) of the Act. 1…
