On May 18, 1900, Chauncey B. Tilton died in Franklin County, Massachusetts, of which place he was a resident, leaving a will in which Alonzo M. Rice, Dexter F. Hagar and Eliza A. Howland, plaintiffs in error (hereinafter called plaintiffs), were named as executors and executrix, respectively, of said will. They were residents of Massachusetts. William E. Tilton, the defendant in error (hereinafter called defendant), is a son of decedent, a resident of Carbon County, Wyoming, and a legatee and devisee under the will.
