The .preliminary question is presented by a motion to dismiss the appeal in this case on the grounds(l) that there is no proper record before this court upon which it can pass, judgment or affirm or reverse the judgment of the lower court; (2) that no case-made was ever served upon defendant in error, or signed, settled, tor allowed by the trial court, or by the judge of said court.
