This was a claim by the appellee against the appellants, as the administrators of the estate of Thomas Huston, deceased. The appellee’s claim or complaint contained two paragraphs, to each of which the appellants’ demurrer, for the alleged insufficiency-of the facts' therein to constitute a cause of action, was overruled by the court and to this ruling they excepted. They then answered in six paragraphs, and the appellee’s demurrer to the fifth paragraph, for the want of facts therein to constitute a defence to its action, was sustained by the court, and to this decision they ex*23cepted.
