This was a suit by the appellee Thomas Baker, as sole plaintiff, against the appellant and Eleanor X). Ellsworth, who is named as an appellee in this court, as defendants, upon a policy of insurance executed by the appellant to said Eleanor D. Ellsworth, whereby the appellant, in consideration of fifty dollars to it paid by the assured, did insure the said Eleanor D.
