JACKSON, Justice.

The issues in this appeal stem from a pre-trial conference conducted on November 22, 1961, pursuant to a rule of practice adopted by this court on November 1, 1948, for pre-trial hearings. See 12 O.S.A. Chap. 11, at page 539. The pre-trial conference was conducted prior to the effective date of this court’s order establishing uniform rules for the trial courts of this stale. See 12 O.S.1961, Chap. 2—Appendix, Vol. 1. O.S.1961, page 776.
