Upon appeal from a justice' of the. peace this case was tried in the Circuit Court, where the plaintiffs recovered judgment upon the verdict of a jury for $112.19. The defendant appeals.

The evidence shows that the plaintiffs operated a grain elevator at Fairbanks, a station upon the defendant’s railroad; that at such station the defendant maintained neither a depot, station agent nor scales; that during June, 1908, the plaintiffs shipped five cars of com from Fairbanks to Cincinnati over the defendant’s railroad; that there being no scales or agent at Fairbanks, the plaintiffs themselves…
