This is an appeal by the Chicago and Alton Railroad Company from a judgment of the Appellate Court for the Third District affirming a judgment for the sum of $4200 recovered by Nathaniel T. Kirby, the appellee, against the appellant, in the circuit court of Sangamon county, in an action of assumpsit to recover damages for the breach of an alleged special contract entered into by appellant with appellee, whereby appellant was obligated to transport a car-load of horses from Springfield, Illinois, to Joliet, Illinois, and to secure transportation for the car from that point to New…
