ROTH, J., pro tem.

At 8 o'clock in the evening of May 2, 1932, plaintiff and appellant alighted at the intersection of Eagle Rock Boulevard and Avenue 33 from a northbound street car operated by defendant corporation. At that point and for a considerable distance to the north and south, a street car proceeds on a right of way owned by said defendant. A cement sidewalk crosses the right of way from the east to the west.
