On or about the hour of 10 o’clock P. M., on the thirtieth day of August, 1927, an automobile, driven by the defendant, collided with, ran over and seriously injured the plaintiff Winifred Cleveland. In this action the plaintiffs had judgment against the defendant for damages on account of the injuries sustained. From this judgment the defendant appeals.
