As the result of an undercover investigation aimed at reaching higher-ups, defendant Ramon (Manny) Rivera was tried on three counts of a four count indictment, count one charging conspiracy with John H. Azulay and Martin A. Chutjian, and others presently unknown, until on or about March 31, 1987, to “possess with intent to distribute a quantity of cocaine” in violation of 21 U.S.C. §§ 841(a)(1) and 846.
