Defendant Kenneth Barton was indicted for the crime of assault with intent to commit manslaughter upon Anna Barton (his mother), and with being a habitual criminal, in violation of section 747.5, Code, 1962, in that he had' twice previously been convicted of crime, sentenced and committed to prison for terms of five years. Two competent, experienced attorneys were appointed. to defend, him. Upon his plea of not guilty to the crime of assault with intent to commit manslaughter defendant was tried and found guilty by a jury.
