In a personal injury action the plaintiff recovered a verdict, and the defendant appealed from an order denying its motion for judgment notwithstanding the verdict or for a new trial. It is conceded that the respondent was injured while in the employ of the appellant, and the question on this appeal is whether he was injured under conditions which bring the case within the rule of Barrett v.
