Action in the district court for Wright county to recover $5,000 for personal injuries. The case was tried before Giddings, J., who directed a verdict in favor of defendant. From an order denying a motion for a new trial, plaintiff appealed.

The plaintiff was injured while in the employ of the defendant railway company, and brought this action to recover damages on the ground of the alleged negligence of the defendant. At the close of the plaintiff’s case, the court' directed a verdict in favor of the defendant, and from an order denying a motion for a new trial, the plaintiff appeals to this court.

The facts are comparatively simple and easily understood. The plaintiff was employed by the defendant railroad company as a pitman with one of the steam shovel crews engaged in shoveling gravel from *304■a gravel pit in New London. He…
