Fidelity Service Corporation (“Fidelity”) and Property Advisory Group (“PAG”) have brought this action seeking a declaratory judgment under Rule 57, Fed.R.Civ.P., stating that their real estate management agent, Cooper Hill, Inc. (“Cooper Hill”) lacked authority to execute an agreement binding plaintiffs to collective bargaining agreements negotiated between defendants Realty Advisory Board (“RAB”) and Local 32B-32J (“the Union”).
