This is an appeal from a judgment of the district court of Wells county. The facts are as follows: One J. F. Maixner died on or about June 1, 1923, domiciled in Wells county, leaving an estate, the gross value of which was less than $4,500. At the time of his death, Maixner was married, but had no children. The mother of the decedent had died some time prior to the first of June, 1923. At the time of his death, there was a valid and subsisting policy of insuiv anee upon his life, in the sum of $2,000, payable to the estate of the insured. -
