The matter before the Court is an ancillary proceeding arising out of an action filed in the federal court for the District of Connecticut on February 16, 1993 and transferred to the Southern District of New York two days later. Petitioners, Don G. Angelí and Angelí Group Incorporated (hereinafter denominated as “Angelí”), have filed a motion pur*587suant to Fed.R.Civ.P. 45 to require respondent to pay the costs and expenses which Angelí incurred in complying with subpoenas directed to them as non-parties.
