WALKER, Circuit Judge.

This suit was brought by the appellee against the appellant in a Florida state court in March, 1922. The parties are herein referred to' as plaintiff and defendant, respectively. The declaration contained seven counts, each claiming the sum of $11,-*654000,000. All the counts except the seventh were common counts. The seventh count ¡contained averments to the following effect:
