This is an action for specific performance. When it first came before this court it was sent back for further evidence in accordance with § 28-2732 ND Dev Code 1943 and in conformity with the rule laid down in Hettinger County v. Trousdale, 69 ND 505, 288 NW 25. At that time Justice A. Gr. Burr wrote an exhaustive opinion in Arhart v. Thompson, reported ante, 189, 26 NW2d 523, which became the law of the case.
