Tbis action was brought to enjoin tbe defendant from cutting down a row of shade trees standing on tbe outer edge of tbe sidewalk in front of plaintiff’s residence in Greenville, for tbe purpose of widening Fifth Street. Tbe court, after having granted a temporary restraining order, refused to continue it to tbe final bearing, and tbe plaintiff appealed.
