MEMORANDUM OPINION AND ORDER

CASTILLO, District Judge.

Plaintiffs Harry and Patricia Benion have brought this class action suit against Bank One, Dayton, N.A., Echo Acceptance Corporation, and Superior Satellite, Inc., alleging violations of the Truth In Lending Act (“TILA”) in Count I, and the Illinois Consumer Fraud Act (“ICFA”) in Count II. Bank One and Echo have moved for summary judgment pursuant to Fed.R.Civ.P. 56.
