OPINION ON APPELLEE’S PETITION FOR DISCRETIONARY REVIEW
MALONEY, Judge.
Appellee was indicted for unlawful possession of marijuana. Appellee filed a motion to suppress evidence seized during a Texas Department of Public Safety (DPS) automobile roadblock stop. The trial court granted appellee’s motion, finding “that such a checkpoint stop for the purpose of checking insurance coverage in addition to a Driver’s License check is not authorized by law and is therefore an illegal stop.... ” The State appealed.1 The Thirteenth Court of Appeals reversed.
