Now before the Court is a motion by Plaintiff and Counterclaim-Defendant First Advantage Background Services (“First Advantage”) to dismiss the Fifth, Sixth, and Seventh causes of action in Defendant-Counterclaimant Private Eyes, Inc.’s (“Private Eyes” or “PEI”) First Amended Counterclaim.
