EAGER, Judge.

This case was first submitted in Division, and an opinion adopted; upon a dissent the case was transferred to the Court in Banc. The suit is one for damages against two physicians and the executor of a third, as partners operating the Neurological Hospital in Kansas City for the •care and treatment of mental and nervous •diseases. Plaintiff escaped from the hospital on September 22, 19SS, by jumping or ■dropping from a window, and was seriously injured. A jury returned a verdict for him in the sum of $40,000.
