MEMORANDUM OPINION AND ORDER

GRAHAM, District Judge.

On May 20, 1999, the court granted plaintiffs’ motion for partial summary judgment and denied defendants’ motion for summary judgment. This court held that defendants’ efforts to collect attorneys fees in the action they prosecuted against plaintiffs Samuel and Louise Taylor on behalf of their client, National Bank & Trust company, violated the Fair Debt Collection Practices Act (“FDCPA”), 15 U.S.C. § 1692 et seq., because the recovery of attorneys fees by a creditor in the position of the bank was not permitted by Ohio law and thus violated…
