delivered the opinion of the Court.

Shasta Drilling Company and James G. McCarrick formerly owned in equal parts oil and ga.s leases covering two tracts of land in Nueces County, one tract, known as the Erigan tract containing 10.46 acres, and the other, known as the Quiroz tract, containing a little more than 80 acres. On November 1, 1935, Shasta assigned its 1/2 interest in these leases to Mc-Carrick and W. A. Richardson, in consideration of $30,000.00 to be paid out of 1/8 of 7/8 of the first oil produced from the leased premises.
