Petitioner, Mrs. Ida Rosenbaum, joined pro forma by her husband, F. W. Rosenbaum, brought this suit to rescind a con*327tract theretofore entered into by and between her and the respondents on the ground that same was induced by fraud and also to cancel a note executed by her and her husband. The contract was for the sale by the respondents to Mrs. Rosenbaum of certain stocks and bonds of the respondent, Texas Building and Mortgage Company.
