In State v. Dukette, 122 N.H. 336, 444 A.2d 547 (1982), this court affirmed the defendant’s conviction for aggravated felonious sexual assault perpetrated by means of physical force. RSA 632-A:2, I (Supp. 1983). After we had denied the defendant’s subsequent petition for writ of habeas corpus, Dukette v. Perrin, No. 82-531, the United States District Court for the District of New Hampshire vacated the conviction in the exercise of its own habeas corpus jurisdiction, based on the trial court’s failure to instruct the jury on a lesser-included offense.
