OPINION AND ORDER DENYING MOTION FOR SUMMARY JUDGMENT

The debtor, Kollel Mateh Efraim, LLC, is the assignee of a contract to purchase certain real property owned by Helen-May Holdings, Inc. (“Helen-May”). After a dispute arose between the parties, the debtor filed this chapter 11 case, and the parties engaged in litigation over the contract and the chapter 11 case. At the conclusion of an evidentiary hearing, counsel for the parties stipulated to a settlement of their disputes on the record in open court.
