OPINION

This matter comes before this Court on the motion of Defendants Michael Cher-toff, Russell Owen, and the United States Citizenship and Immigration Services (collectively “Defendants”), to dismiss the Complaint for lack of subject matter juris diction, pursuant to Fed.R.CivP. 12(b)(1). 1 For the reasons set forth below, Defendants’ motion is denied.
