There are 2 issues in this criminal appeal. One relates to venue and the other to the problem of the recanting witness. Enough of the sordid facts will be given to frame a context for discussion of these issues.

The appellant was charged with statutory rape apon his then 11-year-old daughter. In the evening of the day on which the offense was alleged to have been committed, her father took, her in his car to purchase groceries.
