OPINION

LEISURE, District Judge:

Plaintiff Margaret Margrave (“Mar-grave”) claims that she suffered a back injury as the result of an accident aboard a plane owned by defendant British Airways, and that the airline is therefore liable for her ensuing damages under the Warsaw Convention. 1 British Airways now moves to dismiss Margrave’s claim for failure to state a cause of action, pursuant to Fed.R.
