— Plaintiff brought this action upon a number of assigned accounts, alleging that the defendants were copartners engaged in the operation of a saw mill at Rochester, Washington. The cause was tried to a jury, and from the judgment entered upon a verdict rendered in favor of the plaintiff, the defendants, W. S. Oram and George Pearce, the only ones served with process, have appealed.

At the trial, the amounts due upon the various claims were agreed upon, and the main issue centered around the question of whether or not there was a copartnership.
