This is an appeal challenging four interlocutory orders entered by the trial court on motions filed by the plaintiff, Arthur J. Rocque, Jr., the commissioner of environmental protection. The defendants Philip Joseph DeMilo and DeMilo & Company, Inc., appeal from the court’s granting of the plaintiffs (1) motion to substitute a party after the death of defendant Frank DeMilo, (2) motion to withdraw claims against Frank DeMilo, (3) motion to dismiss the defendants’ counterclaim and (4) motion for permission to withdraw counts one through nine of the amended complaint.
