HARTSHORNE, District Judge.
Tipper Tie, Inc., a New Jersey corporation, sues for a declaratory judgment1 as to the invalidity of the Frank and Macy patent2 assigned to defendant Hercules Fasteners, Inc., a New Jersey corporation — Hercules. In turn, Hercules counterclaims against Tipper Tie, claiming that it infringed by the use of a process and product for the closure of sausage casings, covered by such patent owned by Hercules, hereafter called the Hercules patent.
