This matter comes before the court on defendants’ motion (# 40) for summary judgment. For the reasons stated below, *1075the motion is granted in part and denied in part.

BACKGROUND

Plaintiff John Neighorn (“Neighorn”) filed this action on September 30, 2011, against defendants Quest Health Care (“Quest”) and Rotech Healthcare, Inc.
