JAMES HUNTER, III, Circuit Judge.

1. In this appeal, plaintiffs ask this court to reverse the trial court’s denial of their motion for attorneys’ fees. Plaintiffs sought attorneys’ fees under the Civil Rights Attorneys’ Fees Awards Act of 1976, 42 U.S.C. § 1988 (1976), as prevailing parties in an action under the 1871 Civil Rights Act, 42 U.S.C. § 1983 (1976). The district court denied their motion, finding that the defendant housing authority was an agent of the federal government, immune under 28 U.S.C. § 2412 (1976), from the operation of section 1988.
