On remand from the Texas Supreme Court, we consider whether the trial court erred in granting summary judgment in favor of one of the parties, Bob E. Carpenter (Carpenter), in his individual capacity. This case involves a default summary judgment granted in favor of appellees, Carpenter and C.D. Consulting and Operating Company and C.D. Roustabout Company and Equipment Sales (“the C.D. Companies”), when appellant, Cimarron Hydrocarbons Co.
