This is a diversity action brought by The Northwestern Mutual Life Insurance Company (“Northwestern Life”), Mason Street Funds, Inc. (“Mason Street”) and Northwestern Mutual Series Fund, Inc. (“Northwestern Mutual”) (collectively “the plaintiffs”) against Banc of America Securities LLC (“Banc of America”), First Union Securities, Inc. (“First Union”) and Goldman, Sachs & Co.
