Plaintiff sued for balance of the purchase price claimed to be due on a contract of sale, alleging delivery and performance in accordance with the terms of the contract. Defendant denied the allegations of performance and counterclaimed on the ground that the terms of the contract with respect to good will had been violated. The issues were submitted to a jury and a verdict was rendered against plaintiff on its claim and for defendant on its counterclaim in the amount of $15,000.
