Appeal from a judgment of Monroe County Court (Marks, J), entered October 16, 1995, convicting defendant after a jury trial of, inter alia, murder in the second degree (five counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by reversing those parts convicting defendant of two counts of robbery in the first degree under counts five and six of the indictment and vacating the sentences imposed thereon and as modi*1319fied the judgment is affirmed, and a new trial is granted on counts five and six of the indictment.
