Citizens for Jazz on WRVR, Inc. (“Citizens”) appeals from a decision of the Federal Communications Commission rejecting without a hearing its petition to deny the application of Riverside Broadcasting Company, Inc. (“Riverside”) for a radio broadcasting license renewal. The case presents the question of the proper standard to be used by the Commission in determining whether a petition to deny on the basis of licensee misrepresentation presents “a substantial and material question of fact” and therefore must be set for hearing, 47 U.S.C. § 309(d)(2) (1982); and the…
