This military pay case comes before the court on the parties’ cross-motions for summary judgment. The first question presented is whether the Government is estopped from denying the validity of its approval of plaintiffs request for an active duty term of indefinite duration. The second question is whether plaintiff was entitled to have his release from active duty as a commissioned officer in the U.S. Army Reserves reviewed by a board of officers prior to his release.
