Plaintiff, seeking to recover damages for the breach of Harry D. Barasch, a licensed real estate broker, brought this action against him and against defendant corporation as surety upon his $2,000 bond under the Real Estate Brokers’ Act of 1919, as amended (Stats. 1919, p. 1252, Act 61; Stats. 1925, chap. 341, p. 600). The cause was tried before the court without a jury, upon stipulated facts, and the court thereafter made its findings; and entered judgment in favor of plaintiff and against defendant corporation, from which judgment said defendant now appeals.
