OPINION OF THE COURT
This is an appeal by the plaintiff, Randolph Smith, from an order of the District Court of the Virgin Islands reversing on appeal a judgment of the Municipal Court of the Virgin Islands in his favor against Hertz Rent-A-Car. The suit was brought to recover damages to the plaintiff’s automobile resulting from a collision which occurred on January 20,1965 in St. Thomas between the plaintiff’s automobile and an automobile driven at the time by defendant Bernard C.
