VANCE, Circuit Judge:
Appellant T. J. Fountain, Jr. appeals from the district court order dismissing his complaint. The district court dismissed for lack of subject matter jurisdiction two counts of appellant’s complaint alleging denial of his federal constitutional rights. Additionally, the court dismissed a third count of the complaint alleging denial of a federal statutory right for failure to state a claim upon which relief can be granted and declined to exercise jurisdiction over several pendent state claims.
