We will herein refer to the parties as they appeared in the trial court, where plaintiffs in error were plaintiffs and defendants in error were defendants.

In their complaint, plaintiffs named as defendants the administratrix of the estate of Minnie Phillips, deceased, and all the heirs at law of said decedent. Gladys A. Armbruster was named a defendant, as administratrix and as an heir at law, and was personally served with process in the action. All other defendants are nonresidents.
