CLANCY, District Judge.

This is an action for a declaratory judgment brought by James H. Durkin, indi-, vidually and as President of the “United Office and Professional Workers of America”, a labor union, against the' defendant John Hancock Mutual Life Insurance Company. The plaintiff seeks a declaration of its rights under a certain contract which it made with defendant, to the collection by defendant and its disposition of certain funds under the check-off provisions of that contract.
