The petitioner was sentenced to imprisonment for a term of not less than two nor more than ten years, following his conviction under the Narcotic Drug Act, which ■provides (§ 54-7-15, N.M.S.A.1953) that ■probation or parole shall not be granted imtil the minimum imprisonment provided for the offense shall have been served. Petitioner’s parole was authorized by the ■state parole' board to become effective De■cember 24, 1964, less than two years after the sentence, but was cancelled when the ■statutory prohibition against parole was •called to the attention of the board.
