After the trial court denied a pretrial motion to suppress evidence obtained during a traffic stop that was filed by appellant, Dino Ferreira Scardino, a jury found him guilty of driving while intoxicated, a Class B misdemeanor, which was enhanced to a Class A misdemeanor because of a prior conviction for driving while intoxicated. See Tex. Penal Code Ann. § 49.04 (Vernon 2003), § 49.09(a) (Vernon Supp. 2008).
